How Spanish unfair-competition, advertising, and EU AI Act transparency rules apply to Restage outputs you publish.

What this page is

Listing photographs are advertising. In Spain, an AI-edited room that a buyer would take as the current state of the home can be unfair competition and misleading advertising. Restage labels outputs so you can stay on the right side of that line. You decide what goes on the portal. This notice is guidance for using the product; it is not a legal opinion on a particular ad.

Art. 2

Unfair competition — Ley 3/1991

Article 7 of the Spanish Unfair Competition Act treats as unfair any conduct that is misleading about the characteristics, quality, or nature of goods or services. The Dirección General de Consumo and the trade press have already applied that idea to retouched and AI-generated listing photos. There is no special “AI photo ban”. The general deceit rule is enough.

If furniture is virtual, say so. If a kitchen is a reforma preview, it is not the kitchen. If a terrace does not exist, do not generate it for a listing.

Art. 3

General Advertising Act — Ley 34/1988

Misleading advertising (publicidad engañosa) is unlawful. An image can mislead even when the text of the ad is careful, and even when the photographer started from a real room. Staging that a buyer cannot distinguish from a furnished photograph, published without a recreación virtual disclosure, is the risk. Reforma imagery published as the current state is the same risk, worse.

Consumo and the buyer

Consumer authorities look at the overall impression on a reasonably attentive buyer. Portals are not a shield. If a buyer books a visit because the listing showed a finished kitchen that is still a shell, the complaint lands on the agency. Restage is not the advertiser of your listing.

Housing ads also sit under rules on essential characteristics (including RD 515/1989). Square metres, layout, and finishes in the ficha técnica are not suggestions for the model.

Art. 5

EU AI Act transparency

Where an image is generated or manipulated by AI and could be mistaken for a real photograph, EU transparency duties (AI Act art. 50 and related guidance) require that the AI origin be disclosed. Restage bakes Recreación virtual or VISTA DE REFORMA into the export for that reason. Removing the mark to make the image “look real” on a portal fights that duty.

A clean staging download is a commercial convenience. It is not permission to advertise the room as naturally furnished. Disclosure follows the image, not the JPEG variant.

Art. 7

What you must do when you publish

  1. Use staging outputs only when the architecture matches the home.
  2. Keep Recreación virtual visible, or add an equivalent portal caption if you publish a clean file.
  3. Never use a reforma output as a listing photograph.
  4. Do not hide defects or invent amenities.
  5. If a buyer, owner, or portal asks, produce the original and the Restage certificate.

Art. 8

What you must not do

  • Caption a staged photo as “unfurnished as photographed” when it is not.
  • Run a night-to-day or exterior enhancement that invents a sea view.
  • Use Restage marketing language such as “indistinguishable from a real photo” in your listing. We do not make that claim for listing use, and you should not either.
  • Blame the model if you published the file.

Art. 9

Portal takedowns

Idealista and others can pull ads. That is their platform, not a Restage defect. If they ask you to replace a file, replace it. If Consumo or a competitor writes, answer them; we can confirm from the certificate that a job ran, which mode it used, and that a label was applied. We will not argue your listing for you.

Art. 10

Restage’s own advertising

Our marketing site uses sample rooms, not your listings, and does not offer a free upload of a customer photograph on the public demo. We describe staging as labeled recreación virtual and reforma as a seller preview. If something on getrestage.com looks wrong, write to legal@getrestage.com.

Art. 11

Reports

If you believe a Restage user is publishing unlabeled or deceptive listing photos, tell legal@getrestage.com with the URL of the ad. We can suspend accounts. We cannot edit Idealista.
